Appeal against a decision of an Administrative Court’s decision

If you still do not have the outcome you want after the reconsideration in objection or the legality review by an appellate court, you can appeal the administrative law judge’s ruling. The ruling of the administrative judge will indicate how and where you can appeal.

The Netherlands has the following supreme administrative law courts, among others:

  • Central Appeals Council (including public law benefits);
  • Administrative Law Division of the Council of State (including environmental permits and other spatial issues);
  • Supreme Court (including tax law).
  • These parties charge a fixed fee for instituting proceedings.

Who is ultimately the court of last resort varies and depends on the legal regulation on which the original decision you objected to was based.
